The 9th Circuit Court of Appeals in California has dismissed a class action lawsuit began in 2009 filed by an FFXI player Esther Leong. The gamer alleged that the publisher engaged in deceptive advertising, unfair business practices, and fraudulent concealment with the game.
Leong was looking for $5 million in damages after her characters were deleted when she took a break from the game. She returned to play only to find her account invalidated and her characters and gear lost due to the way Square Enix’s PlayOnline billing service handled accounts.
The 9th Circuit Court dismissed the claim with prejudice, which means Leong’s chances of an appeal are slim.
